4. Medical Disclaimer — No Doctor–Patient Relationship

• The information on the Site is provided for general informational and educational purposes only. It is not medical, optometric, or ophthalmologic advice, diagnosis, or treatment, and it is not a substitute for a consultation with a qualified eye care professional.
• Viewing the Site, sending us a message through the Site, or requesting an appointment does not create a doctor–patient relationship. A doctor–patient relationship is established only after you have been seen and accepted as a patient of the Practice.
• Never disregard or delay seeking professional medical advice because of something you have read on the Site.
• If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. Do not use the Site to communicate urgent medical concerns.

5. Site Information and Availability

• We strive to keep the information on the Site — including descriptions of services, provider credentials, office hours, location, and contact details — accurate and current. However, we do not warrant that such information is always complete, current, or error-free.
• Services, hours, and other details may change without prior notice. Please contact our office by telephone to confirm current information.
• We may modify, suspend, or discontinue any part of the Site at any time without notice.

6. Contact Form and Electronic Communications

• The Site may allow you to send us a message by providing your name, email address, an optional mobile phone number, and a message. Messages sent through the Site or by ordinary email are not encrypted and should not be considered secure or confidential.
• Do not include sensitive personal or health information (such as symptoms, diagnoses, medications, insurance identifiers, or Social Security numbers) in a message sent through the Site. For any matter involving your medical care, please call our office at 203.403.3375.
• We do not guarantee that messages sent through the Site will be received or answered within any particular time. Appointments are scheduled by telephone, not through the Site.

7. SMS / Text Messaging Program

• Program. If you provide your mobile number and consent, you agree to receive clinic-related text messages from Ridgefield Eye Physicians & Surgeons, including appointment reminders, appointment confirmations, and exam recall notices. Optional post-visit surveys may also be sent when you have opted in. We do not send marketing or promotional text messages.
• Consent. You can opt in by checking the text-message consent box on our Contact page (it is unchecked by default), by completing our in-office registration form, or by giving verbal consent to our staff by telephone. Consent is not a condition of purchase or of receiving care.
• Message frequency varies. The number of messages depends on your appointments and recall schedule.
• Message and data rates may apply. Check with your mobile carrier for details of your plan.
• Opt out: reply STOP to cancel at any time. You will receive one final message confirming that you have been unsubscribed, after which no further text messages will be sent to that number.

• Carriers. Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your carrier and to your device being able to receive text messages.
• Privacy. We do not sell or share your mobile number or SMS consent with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy, Section 4.
• Not for urgent matters. Text messages are not monitored around the clock. Do not use text messages to communicate urgent medical concerns; call our office, or in an emergency call 911.

8. Third-Party Links and Services

• The Site contains links to third-party websites and resources that are not owned or controlled by the Practice, including professional associations, hospitals, and patient-education resources. The Site also uses third-party services such as web fonts and an embedded map.
• These links and services are provided for your convenience only. We do not endorse and assume no responsibility for the content, products, services, or practices of any third party.
• Your use of third-party websites and services is subject to their own terms and policies, and is at your own risk.

9. Privacy

You agree to indemnify, defend, and hold harmless the Practice, its physicians, owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, or your infringement of any third-party right, including intellectual property or privacy rights.

13. Governing Law and Dispute Resolution

• These Terms shall be governed by and construed in accordance with the laws of the State of Connecticut, without regard to its conflict of law principles.
• Any dispute arising out of or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in Fairfield County, Connecticut, and you hereby consent to the personal jurisdiction of such courts.
